Official Rules of the Sweapz Application
1. Contest Presentation and Organizer
Organizer: TONAYR, SAS with share capital of €10.00, registered with the RCS of Bergerac under number 990 853 616, whose registered office is located at 120 rue de l'Église, 24560 Colombier, France (hereinafter "the Sponsor").
The Sponsor operates the Sweapz mobile application, a sweepstakes-type application, accessible from France and the United States. These rules constitute a contract between the Sponsor and each eligible participant. Any participation implies unreserved acceptance of the rules.
2. General Eligibility Conditions
Residents and Legal Age: the contest is open to natural persons residing in France or in the 50 United States (and District of Columbia) who have reached the legal age of majority in their country or state of residence. Minors cannot participate.
Exclusions: administrators, employees, subcontractors, and representatives of the Sponsor as well as their immediate family members are excluded.
Excluded Territories: participation is null and void in jurisdictions where it is prohibited or subject to mandatory registration that the Sponsor has not completed.
Identity Verification: potential winners must provide a copy of an official ID and, where applicable, sign an affidavit of eligibility to confirm their age, address, and compliance with the rules.
3. Registration and Participation Methods
Free Registration: creating a user account is free. Upon registration, the user receives virtual coins and entry tickets at no cost.
Obtaining Tickets: users can obtain additional tickets by:
- logging in daily and claiming free rewards;
- watching advertisements;
- completing tasks offered by partners;
- using any other free method offered by the application.
No Consideration Required: participation requires no payment or purchase. The Sponsor will never ask for a credit card, check, or other payment method to validate a win.
4. Contest Duration
Participation Periods: each draw is open during a specific period published in the application. All times are expressed in Coordinated Universal Time (UTC).
Modification or Cancellation: the Sponsor may modify, suspend, or cancel a draw due to circumstances beyond its control (force majeure, fraud, or technical malfunction), provided participants are notified.
5. Winner Selection and Odds of Winning
Random Drawing: winners are designated by a certified randomization algorithm. No result is predetermined.
Odds of Winning: the probability of winning depends on the number of tickets held by the user.
Winner Designation: winners will be notified by notification in the application and/or by email. They must confirm their identity and eligibility within a reasonable time.
6. Prizes and Prize Distribution
Prize Description: the precise description, quantity, and approximate retail value of prizes offered will be indicated for each draw.
Substitution and Non-Accumulation: no transfer, assignment, or substitution of prizes is authorized, except the Sponsor reserves the right to provide a prize of equal or greater value in case of unavailability.
Tax Responsibilities: winners are responsible for all applicable federal, state, or local taxes.
7. Fraud, Prohibitions, and Sanctions
Cheating and Manipulation: any attempt to commit fraud, hack the application, or modify the terminal to bypass protection mechanisms is prohibited.
Account Sharing: it is prohibited to transfer or share your account. Each account is personal.
Exclusion: the Sponsor may disqualify any non-compliant registration. The Sponsor's decisions are final and without appeal.
8. Personal Data and Confidentiality
The Sponsor collects personal information (name, address, email address, date of birth, etc.) to manage registration, participation, and fight fraud. In France, the collection is based on explicit consent and GDPR. Participants can access, correct, and delete their data.
9. Limitation of Liability
The Sponsor is not responsible for technical malfunctions, network disruptions, participation not received, or any damage resulting from participation, except in case of gross negligence or intentional misconduct.
10. Disputes and Applicable Law
For French participants: the contest is governed by French law.
For American participants: the contest is governed by the law of the Sponsor's state of domicile and applicable federal and state laws.
11. Miscellaneous Provisions
Participation in the contest implies full acceptance of the rules. A complete copy of the rules can be obtained by written request addressed to the Sponsor at the following address:
